6/12/2024Spencer Bomar recently had a case dismissed on plaintiff's failure to comply with OCGA 9-11-9.1.
OCGA 9-11-9.1 requires a Plaintiff in a medical malpractice case to attach an affidavit of a qualified expert that outlines the allegations of wrongdoing against the defendnat medical provider. Plaintiff in this case failed to satisfiy this procedural burden, and Spencer was able to have the case dismissed on that basis.
