Summary Judgment in Amusement Ride Case
07/27/2023Andrew Bagley recently obtained summary judgment for an amusement park in a premises liability claim.
The plaintiff alleged that she was injured while riding an allegedly defective roller coaster. However, Andrew established that the ride was in good working order on the date of the alleged incident and that ride operators acted appropriately. Andrew also deposed the Plaintiff's physician and secured testimony that the alleged injuries were preexisting and were not caused by the ride. After a hearing on the matter, the court issued a lengthy order granting the motion and dismissing the case.
