Summary judgment in active shooter case


The plaintiff alleged that the security company was negligent in failing to prevent the assailant from gaining access to the facility where he shot 6 individuals, including the plaintiff, before committing suicide. Our team showed that the security contractor owed no duty to the plaintiff and that no act or omission on the part of the security company caused or contributed to the incident. Judge ruled from the bench at oral argument that the evidence demonstrated that client complied with all its contractual and legal duties, and no act or omission on behalf of client caused or contributed to plaintiff’s alleged damages.
