After deposing the plaintiff’s two causation experts, Andrew moved to have their testimony excluded on the grounds that they failed the test for reliability set forth in Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993). The Court agreed and not only excluded the expert testimony but ruled that the claim was subject to summary adjudication without them.
